Overview
Cass County is located in Nebraska with a population of approximately 27,000. The Cass County Court handles all probate and estate matters for decedents who were domiciled in the county at the time of death.
Nebraska probate is governed by the Nebraska Probate Code (Chapter 30). The process begins with filing a Petition for Informal Probate of Will and/or Informal Appointment of Personal Representative (Form CC 15:2) to admit the will and appoint a personal representative. The court then issues Letters Testamentary for testate estates or Letters of Administration for intestate estates.
Nebraska offers a simplified procedure for small estates. If the value of the decedent's personal property (less liens and encumbrances) does not exceed $100,000, successors may claim assets via a Small Estate Affidavit after a 30-day waiting period. Real property valued at $100,000 or less may also be transferred via affidavit under certain conditions.
Nebraska does not have a statutory fee schedule for attorneys or personal representatives; fees must be reasonable based on the services provided.

Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Small Estate Affidavit: If the net value of personal property is $100,000 or less, you may be able to use an affidavit to collect assets 30 days after death.
- Real Property Affidavit: Real estate valued at $100,000 or less may also be transferred by affidavit under specific circumstances.
- Trust administration: Assets held in a living trust generally do not require probate.
Step 2: File the Petition
If formal probate is needed, file a Petition for Informal Probate (Form CC 15:2) with the Cass County Court. Include:
- Application for Informal Probate
- Original will and codicils (if any)
- Certified death certificate
- Filing fee (approx. $22 base fee + court costs)
- Renunciations/Nominations from other heirs if applicable
Nebraska courts utilize the JUSTICE e-filing system for attorneys. Self-represented litigants may file in person or by mail.
Step 3: Provide Notice
After filing, you must:
- Mail notice of the proceedings to all heirs, beneficiaries, and interested parties within 30 days of appointment.
- Publish notice to creditors in a newspaper of general circulation in Cass County (e.g., Plattsmouth Journal) once a week for three successive weeks.
Step 4: Attend the Hearing
For informal probate, a hearing is often not required if all paperwork is in order and uncontested. The Registrar can issue the Statement of Informal Probate immediately. If the matter is formal or contested, a hearing will be scheduled.
Step 5: Administer the Estate
After receiving Letters, the personal representative must:
- Notify creditors and allow for the two-month claim period after first publication.
- Inventory and appraise all estate assets within three months of appointment.
- Pay valid creditor claims and administrative expenses.
- File federal and state tax returns as needed (including Nebraska inheritance tax).
- Distribute assets to beneficiaries.
- File a Formal or Informal Closing Statement to close the estate.
