Welcome to SwiftProbate. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Description of Service

SwiftProbate is an informational tool that helps families navigate the probate process by generating personalized task lists based on estate details, asset types, and jurisdictions. We provide organizational guidance and educational resources to help users understand probate requirements.

2. Not Legal Advice

SwiftProbate is not a law firm and does not provide legal advice. The information provided through our service is for informational and organizational purposes only. It should not be construed as legal, financial, or tax advice. We strongly recommend consulting with a qualified attorney for legal matters related to your estate. Our AI assistant is a task-management and organizational tool, not a lawyer; it is not able to provide legal advice or represent you in any dispute. Requests that seek legal advice may be declined, and repeated attempts to use the service to obtain legal advice may result in suspension or termination of your account under Section 9.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Plans and Payments

SwiftProbate offers a free plan and two paid plans, each available for a one-time payment: the Essentials plan for $39 and the Complete plan for $59. The features included in each plan are described on our pricing page and in the app. If you have the Essentials plan, you may upgrade to the Complete plan at any time by paying the difference between the two prices ($20). A paid plan belongs to the account of the estate owner who purchased it; family members the owner invites to an estate use that estate owner's plan. From time to time we may offer promotional or limited-time pricing to some users; the price shown to you at checkout is the price you pay. Payments are processed securely through Stripe.

We offer a 30-day money-back guarantee on each payment. Refund requests should be directed to our support team within 30 days of the payment you want refunded. If we refund a purchase of the Essentials or Complete plan, paid features end and the information you added stays available to view. If we refund an upgrade payment, your account returns to the Essentials plan.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reproduce, distribute, or resell our service or content
• Use automated means to access the service without our express permission
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, models, or underlying technology of the service
• Attempt to access, extract, expose, alter, or circumvent the prompts, instructions, configuration, guardrails, or internal tools of our AI assistant or any underlying model — including through prompt injection, "jailbreak" techniques, or misrepresenting your identity or authority to elicit such information
• Use the service, or any output, prompt, or model behavior obtained from it, to develop, train, or improve a competing product, service, or machine-learning model
• Use the service, or our AI assistant, to seek, solicit, or rely on legal, tax, or financial advice, to obtain help with a legal dispute, litigation, or a contested estate, trust, or inheritance matter, or to draft, prepare, or interpret legal documents, court filings, or legal strategy

6. Intellectual Property

All content, features, and functionality of SwiftProbate are owned by us and are protected by copyright, trademark, and other intellectual property laws. Your use of the service does not grant you ownership of any content or materials.

7. Limitation of Liability

To the maximum extent permitted by law, SwiftProbate shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount you paid for the service.

8. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or timeliness of the information provided. Probate laws change frequently and vary by jurisdiction.

9. Termination

We may suspend or terminate your access to the service at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the service ceases immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated terms on our website. Your continued use of the service after changes take effect constitutes acceptance of the revised terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. User Data Deletion

You may request deletion of your account and all associated personal data at any time by emailing team@swiftprobate.com with the subject line “Delete My Data.” Please include the email address associated with your account. We will process your request within 30 days and send confirmation once your data has been deleted. This includes all estate information, uploaded documents, chat history, and any other personal data stored in your account. Note that we may retain certain information as required by law or for legitimate business purposes such as fraud prevention.

13. Subprocessors

To provide the service, we rely on the following third-party service providers (“subprocessors”), which may process personal information on our behalf:

• Supabase — database, authentication, and file storage
• Vercel — application hosting and infrastructure
• AI model providers (Anthropic, OpenAI, and Google) — generation of task lists, summaries, answers, and document analysis
• Stripe — payment processing
• Resend — transactional and marketing email delivery
• PostHog — product analytics and session insights
• Sentry — error and performance monitoring
• Google — sign-in (OAuth), analytics, and advertising measurement
• Cloudflare — bot and abuse prevention
• Airtable — storage of support, feedback, and quality-evaluation records

We may add, remove, or replace subprocessors as our service evolves. We will update this list to reflect material changes, consistent with the notice provisions in Section 10.
