Parking and Access
Metered street parking is available along Main Street in front of the courthouse. There is also a public parking lot located behind the courthouse building. Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Small Estate Petition: For estates valued at $50,000 or less (excluding real estate), you may file a petition for a decree of distribution without full administration.
- Direct Payment (Section 3101): Financial institutions may release up to $10,000 in assets directly to a surviving spouse, child, parent, or sibling without court proceedings.
- Trust administration: Assets held in a living trust generally do not require probate.
Step 2: File the Petition
If formal probate is needed, file a Petition for Grant of Letters with the Tioga County Register of Wills. Include:
- Original Will and codicils (if applicable)
- Certified Death Certificate
- Estate Information Sheet (Form RW-01)
- Renunciations from other heirs (if applicable)
- Filing fee (check or cash; credit cards may incur a fee)
- Valid photo ID for the personal representative
Step 3: Provide Notice
After filing, you must:
- Mail notice (Rule 10.5 Notice) to all heirs, beneficiaries, and interested parties within 3 months of the grant of letters.
- Publish notice in two newspapers of general circulation in Tioga County (as there is no designated legal journal) once a week for three successive weeks.
