Overview
Loudoun County is located in Virginia with a population of approximately 443,380. The Loudoun County Circuit Court handles all probate and estate matters for decedents who were domiciled in the county at the time of death.
Virginia probate is governed by Title 64.2 of the Code of Virginia. The process begins with filing a Probate Information Form (Form CC-1650) and the will (if applicable) to appoint a personal representative. The court then issues Letters Testamentary for testate estates or Letters of Administration for intestate estates.
Virginia offers a simplified procedure for small estates. If the decedent's personal estate does not exceed $50,000 (check current statutes as this threshold is subject to change), a Small Estate Affidavit may be used after a 60-day waiting period to collect assets without full probate administration.
Virginia probate fees include a state probate tax of $0.10 per $100 of the estate's value and a local probate tax of $0.0333 per $100. There are also recording fees and qualification fees based on the value of the estate.

Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Small Estate Affidavit: If the personal estate is valued at $50,000 or less (and at least 60 days have passed since death), you may be able to use an affidavit to collect assets without a formal court appointment.
- Real Estate Affidavit: If the decedent owned only real estate, a Real Estate Affidavit can be recorded to update land records.
- Trust administration: Assets held in a living trust generally do not require probate.
Step 2: File the Petition
If formal probate is needed, schedule an appointment with the Probate Division. You will generally need to bring or file:
- Probate Information Form (CC-1650)
- Original Last Will and Testament (if any)
- Certified Death Certificate
- Cash, check, or credit card for filing fees (State and Local Probate Tax, recording fees)
- List of Heirs (CC-1611)
- Valid Photo ID for the person qualifying
The Loudoun County Circuit Court typically requires an appointment for probate qualification.
Step 3: Provide Notice
After qualification, you must:
- Mail notice of probate (Form CC-1616) to all heirs and beneficiaries within 30 days of qualification.
- File an Affidavit of Notice (Form CC-1617) with the Clerk's office within 4 months verifying that notice was sent.
Step 4: Inventory and Appraisal
The personal representative must file a complete Inventory (Form CC-1670) of the estate's assets with the Commissioner of Accounts within 4 months of qualification.
Step 5: Administer the Estate
After receiving Letters, the personal representative must:
- Obtain a Tax ID (EIN) for the estate
- Open an estate bank account
- Pay valid debts and administrative expenses
- File federal and state tax returns as needed
- Distribute remaining assets to beneficiaries
- File a Final Accounting with the Commissioner of Accounts (typically due 16 months after qualification) to close the estate.
