Overview
Greene County is located in New York with a population of approximately 47,000. The Greene County Surrogate's Court handles all probate and estate matters for decedents who were domiciled in the county at the time of death.
New York probate is governed by the Surrogate's Court Procedure Act (SCPA). The process begins with filing a Petition for Probate (Form P-1) to admit the will and appoint a personal representative. The court then issues Letters Testamentary for testate estates or Letters of Administration for intestate estates.
New York offers a simplified process called Voluntary Administration for small estates valued at $50,000 or less (excluding certain assets like jointly held property). This involves filing a "Small Estate Affidavit" (Form SE-1) for a nominal fee.
New York State law sets statutory commissions for executors based on the value of the estate (SCPA § 2307), starting at 5% for the first $100,000 and decreasing for larger amounts.

Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Voluntary Administration (Small Estate): If the estate is valued at $50,000 or less (personal property only), you may file a Small Estate Affidavit.
- Non-Probate Assets: Assets with named beneficiaries (life insurance, IRAs) or held jointly with rights of survivorship do not go through probate.
- Trust administration: Assets held in a living trust generally do not require probate.
Step 2: File the Petition
If formal probate is needed, file a Petition for Probate (Form P-1) with the Greene County Surrogate's Court. Include:
- Original Last Will and Testament (and any codicils)
- Certified copy of the Death Certificate
- Probate Petition (Form P-1)
- Filing fee (based on the value of the estate)
- Waivers of Process and Consent to Probate from all distributees
E-filing is available and often encouraged via the NYSCEF (New York State Courts Electronic Filing) system.
Step 3: Provide Notice
After filing, you must:
- Serve Citation: If any heirs do not sign a waiver, the court will issue a Citation which must be served on them, notifying them of the probate hearing.
- Publish notice: If the whereabouts of any interested parties are unknown, the court may require publication of a citation in a local newspaper like The Daily Mail.
Step 4: Attend the Hearing
The court will schedule a hearing on the petition, typically 4 to 6 weeks after filing if citations are issued. If all waivers are filed and there are no objections, a hearing may not be necessary. Upon approval, the court issues Letters Testamentary (for wills) or Letters of Administration (no will).
Step 5: Administer the Estate
After receiving Letters, the personal representative must:
- Notify creditors (New York has a 7-month creditor claim period)
- Inventory and appraise all estate assets within 6 months (Form I-1)
- Pay valid creditor claims and funeral expenses
- File federal and state tax returns as needed
- Distribute assets to beneficiaries
- File a Petition for Judicial Settlement or informal accounting with releases to close the estate
