Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Small Estate Affidavit: If the decedent's personal estate is valued at $50,000 or less (excluding real estate), you may be able to use a Small Estate Affidavit after 60 days have passed since the death.
- Transfer on Death: Assets with named beneficiaries (POD/TOD accounts, life insurance) or held in joint tenancy with right of survivorship pass directly to the beneficiary outside of probate.

Step 2: Schedule an Appointment and File
