Overview
Rockingham County is located in Virginia with a population of approximately 87,674. The Rockingham County Circuit Court handles all probate and estate matters for decedents who were domiciled in the county at the time of death.
Virginia probate is governed by Title 64.2 of the Code of Virginia. The process begins with filing a Probate Information Form (CC-1650) to admit the will and appoint a personal representative. The court then issues Letters Testamentary for testate estates or Letters of Administration for intestate estates.
Virginia offers a simplified procedure for small estates. If the decedent's personal probate estate does not exceed $75,000, a Small Estate Affidavit may be used after 60 days have passed since death. Additionally, assets valued at $35,000 or less may sometimes be paid or delivered directly to a successor without an affidavit.
State probate tax is generally $1.00 per $1,000 of the estate's value (for estates over $15,000). Rockingham County charges an additional local probate tax, typically 1/3 of the state tax amount.

Filing Process
Step 1: Determine If Probate Is Necessary
Before filing, assess whether formal probate is required:
- Virginia Small Estate Act Affidavit: If the personal probate estate is valued at $75,000 or less, you may be able to use an affidavit to collect assets after 60 days, avoiding full probate.
- Payment/Delivery of Small Asset: Assets valued at $35,000 or less may be paid or delivered to a successor without an affidavit (Code § 64.2-602).
- Trust administration: Assets held in a living trust generally do not require probate.
Step 2: File the Petition
If formal probate is needed, schedule an appointment and file a Probate Information Form (CC-1650) with the Rockingham County Circuit Court. Include:
- Probate Information Form (CC-1650)
- Original Last Will and Testament (if any)
- Certified Copy of Death Certificate
- Filing fee amount (State and local probate tax + recording fees)
- List of Heirs (Form CC-1611)
E-filing is generally not available for the initial probate qualification; an in-person appointment with the Clerk is typically required.
Step 3: Provide Notice
After qualification, you must:
- Mail notice of probate (Form CC-1616) to all heirs, beneficiaries, and interested parties within 30 days after qualification.
- Publish notice in a newspaper of general circulation in Rockingham County (if required for debts and demands or unknown heirs) for once a week for four successive weeks.
Step 4: Attend the Hearing
In Virginia, the initial probate process is often administrative and handled by the Clerk. If a hearing is required (e.g., for a lost will or dispute), the judge reviews the petition. Upon qualification, the Clerk issues Letters Testamentary or Letters of Administration.
Step 5: Administer the Estate
After receiving Letters, the personal representative must:
- Notify creditors and optionally request a Debts and Demands hearing
- Inventory and appraise all estate assets within 4 months of qualification
- Pay valid creditor claims
- File federal and state tax returns as needed
- Distribute assets to beneficiaries
- File a final accounting and petition for discharge
